The German Ministry of Defence has announced the cancellation of the recent Bundeswehr System Sturmgewehr 5.56mm assault rifle contract award.

The internal examinations initiated thereupon led to the result that a corresponding patent infringement by bidder C.G. Haenel GmbH at the expense of the bidder Heckler and Koch cannot be ruled out. Against this background, the federal awarding authority was required to send the information letter (Section 134 GWB) to the bidders about the intent to cancel award of the contract to C.G. Haenel GmbH.

The federal awarding authority will thus re-evaluate the offers, taking all aspects into account.

Presse-mitteilung, Berlin, 9. Oktober 2020: Sachstand zum Vergabeverfahren ~ System Sturmgewehr der Bundeswehr – Basiswaffe mit Zubehör.

Hiermit informiert das Verteidigungsministerium zum aktuellen Sachstand: Auf Grundlage des am 30. September 2020 bei der 1. Vergabekammer des Bundes beim Bundeskartellamt eingegangenen Nachprüfungsantrags der Firma Heckler und Koch hat die Vergabestelle des Bundes (BAAINBw) erstmalig nachprüfbar von einer möglichen Patentrechtsverletzung durch die Firma C.G. Haenel GmbH Kenntnis erlangt.

Die darauf eingeleiteten internen Prüfungen haben zum Ergebnis geführt, dass eine entsprechende Patentrechtsverletzung durch den Bieter C.G. Haenel GmbH zulasten des Bieters Heckler und Koch nicht auszuschließen ist. Vor diesem Hintergrund war die Vergabestelle des Bundes angehalten, das Informationsschreiben (§ 134 GWB) an die Bieter über die beabsichtigte Zuschlagserteilung an die Firma C.G. Haenel GmbH aufzuheben.

Die Vergabestelle des Bundes wird damit in eine Neubewertung der Angebote unter Berücksichtigung aller Aspekte eintreten.
